By using the app or website, the user agrees to these Terms. Any deviating terms proposed by the user are not recognized.
Tipbetween is a digital platform for brokering tip payments. Its main functions include:
Payment processing is handled exclusively by the payment service provider Stripe. Tip payments are collected via Stripe into Tipbetween's platform account, held there for the recipient until payout, and then forwarded to the recipient's Stripe account and bank account (see section 4).
Using the app requires registration with a valid email address. The user is obligated to:
Dario Cataldo reserves the right to suspend or delete accounts that violate these Terms.
Receiving tips requires a Stripe account. The user completes Stripe's onboarding process and, in doing so, accepts Stripe's terms of service. Payouts follow Stripe's own timelines and conditions. Dario Cataldo is not liable for delays or restrictions caused by Stripe.
Tips received are collected as a balance. The recipient can pay out their balance at any time in the app or choose automatic payouts (monthly or quarterly). Regardless of this, the balance is paid out automatically no later than 80 days after the oldest tip not yet paid out was received.
Stripe charges costs for payouts, which are borne by the recipient. They are deducted from the payout amount:
The exact costs are shown in the app before every payout the recipient initiates and must be confirmed. By choosing an automatic payout schedule, the recipient agrees to the deduction of the costs from every automatic payout. If Stripe changes its rates, the costs are adjusted accordingly and users are informed in advance.
If, when the deadline under section 4.1 is reached, the balance does not cover the payout costs under section 4.2 or does not reach the minimum amount, it is not paid out and is forfeited to Tipbetween to cover platform and processing costs.
Tips that cannot be paid out by that deadline because the recipient has not set up a payout account or the conditions for a payout are not met (for example confirmation of the employment or of the business) are forfeited in the same way.
Tipbetween notifies the recipient at least 14 days before the forfeiture by email and in the app. If the notice is sent later, the forfeiture moves to 14 days after the notice.
For recipients in the USA, tips are forwarded without any deduction: the recipient always receives 100% of their tips and bears no payout costs. Sections 4.1 to 4.3 do not apply to these accounts.
In the USA, Tipbetween bears the payment provider's costs for each payout. Payouts are therefore made automatically at most once per calendar month, as soon as the tips collected since the last payout cover these costs (currently from about USD 50 in tips). Until then the balance is kept in full and shown in the app. Regardless of this, every balance is paid out no later than about 23 months after the oldest payment it contains. Balances are never forfeited in the USA.
If a guest charges back the payment of a tip with their bank or card issuer, the recipient bears the resulting costs: the amount charged back and the payment provider's chargeback fee. If the tip is still in the balance, it is not paid out. The remaining costs, or the full amount for tips already paid out, are offset against the next payouts. Tipbetween informs the recipient by email. If the chargeback is decided in Tipbetween's favour, the offset amount is adjusted accordingly.
Basic use of the app is free. For every tip payment:
Tipbetween Premium is an optional paid subscription with additional features. Current prices are shown in the app. Subscriptions are billed through the Apple App Store and renew automatically unless cancelled at least 24 hours before the end of the current period.
Subscriptions are managed through the user's Apple ID settings.
The user agrees to use the app exclusively for lawful purposes and, in particular, to refrain from:
